New York State authorities say a pizza delivery driver has been charged with assault and battery, and is facing charges in the case.
Christopher A. Brown was arraigned in Albany County Court on Saturday on a felony count of assault and criminal possession of a weapon.
The charge comes a day after authorities say Brown assaulted an elderly man and hit his head with a brick.
Brown is expected to enter a not guilty plea on his behalf at a later date.
The investigation into the attack began when police were called to a Pizza Hut restaurant in Albany on Aug. 16, 2017.
A witness told police that Brown pulled a gun on him and that he “grabbed the pizza and pushed it up into the air.”
Brown is also charged with assaulting the victim, and in connection with that charge is also accused of resisting arrest.
Brown has been with the company since 2014.
